05Frequently asked questions

What is the negotiated crisis settlement?

A voluntary and confidential procedure under the Italian Insolvency Code in which a distressed business is supported by an independent expert in reaching an agreement with its creditors. It is activated through an online platform run by the Chambers of Commerce and, under certain conditions, allows protective measures to be requested.

What duties do directors have?

Article 2086 of the Italian Civil Code requires companies to set up organisational, administrative and accounting structures capable of detecting distress early, and directors to act promptly to overcome it.
